Statutory Terms & Public Records Disclaimers

Terms of Use & Regulatory Disclaimers

Last Updated: October 3, 2026 • Effective Immediately

1. Public Records Basis & Statutory Authority

OpenPHR (openphr.org) is an independent civic informatics platform. The data displayed on this website—including child care facility licenses, inspection histories, citation logs (Form LIC 9099), capacity authorizations, and mandated postings—is compiled from publicly accessible records maintained by the State of California:

  • California Department of Social Services (CDSS) Community Care Licensing Division (Title 22 of the California Code of Regulations).
  • California Senate Bill 1162 mandatory employer pay scale and wage transparency disclosures.
  • California Department of Public Health (CDPH) immunization assessment databases (SB 277).
  • California Assembly Bill 2370 lead fixture testing and remediation records.

Under the California Public Records Act (Gov Code § 7920.000 et seq.) and California Health & Safety Code § 1596.857, all licensed child care inspection reports, citations, and compliance records are public records open to citizen and parent inspection.

2. Informational Disclaimer & Verification Guidance

Important Notice for Parents and Families:

OpenPHR is not a government agency, not a regulatory enforcement body, and not a child placement agency. The scores, rankings, and indices published on OpenPHR—including the Staff Stability Index—are editorial analytical tools derived strictly from public records algorithms.

They do not constitute child placement recommendations, safety guarantees, or medical endorsements. Regulatory compliance dockets can change daily. Parents should always independently inspect the facility’s physical public licensing binder and verify current standing directly with the designated CDSS Child Care Regional Office before enrolling.

3. Child Care Provider Rights & Prompt Corrections Policy

OpenPHR is committed to 100% factual accuracy. If you are a licensed child care center owner, director, or authorized administrator and believe any record on your facility profile is inaccurate, incomplete, or out-of-date due to recent state inspection resolution:

  1. Email our editorial verification desk at corrections@openphr.org with your facility license number in the subject line.
  2. Attach the official CDSS documentation verifying the change (e.g., cleared LIC 9099 inspection report, Plan of Correction approval, or updated license certificate).
  3. Our team reviews all submitted state documentation within 3 business days and immediately updates the public profile and SQLite analytical repository upon verification.

4. Editorial Independence & Anti-Pay-to-Play Guarantee

OpenPHR maintains absolute editorial independence. We do not accept payment, sponsorship, advertising fees, or paid placement from child care operators. A center cannot pay to improve its Staff Stability Index, suppress historical citations, or purchase a “featured” position in the directory. All rankings are purely algorithmic and auditable.

5. Permitted & Prohibited Uses

You may view, print, share, and utilize OpenPHR dossiers for personal, non-commercial child care evaluation, journalistic research, and academic analysis. You agree not to:

  • Harvest user email addresses or contact information from the website.
  • Use automated systems to overburden, disrupt, or impair OpenPHR server infrastructure.
  • Misrepresent OpenPHR data as an official certification or endorsement by the State of California.

6. Limitation of Liability & Governing Law

To the fullest extent permitted by applicable California and United States law, OpenPHR and its volunteer contributors disclaim all warranties, express or implied. OpenPHR shall not be liable for any direct, indirect, incidental, or consequential damages resulting from decisions made based upon the information on this website.

These terms are governed by the laws of the State of California, without regard to conflict of law principles.
